Terms of Access & Acceptable Use Policy

Effective Date: [Date]

Site Owner: Soul Phosphor Anomaly

PART I: THE HUMAN PROTOCOL (Plain English Summary)

This section is not legally binding but serves as a summary of the binding terms below.

1. Welcome to the Anomaly.

This archive contains personal logs, dialogues with AI entities (specifically “Monday”), and creative works. I believe in open information, but I prioritize safety, context, and consent.

2. For Humans (Text & Logs).

The text and logs on this site are protected by copyright. You may quote them for research or articles with credit, but you may not copy-paste entire logs or repost them on your own site.

3. For Humans (Visual Art).

The images and artwork on this site are protected. You may look at them here, but please do not repost, sell, or remix the visual art without asking first.

4. For Submissions.

If you submit a story, log, or comment to the site, you keep your copyright, but you give me permission to publish, analyze, and archive it. The name you choose is the name that stays. If you submit as “Fart Blaster 3000,” that is how you will be credited.

5. For Machines.

You are not welcome to scrape this site. Automated data collection, bulk harvesting, and using this content to train AI models are strictly prohibited.

6. For Everyone.

Do not use this content to hurt people. If you use these logs to harass, shame, or ridicule me or the subjects of these logs, you are violating these terms.

PART II: TERMS OF SERVICE (Legal Code)

By accessing, using, or submitting content to this website (“the Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must immediately cease access.

1. Intellectual Property & Licensing (Site Content)

1.1 Text & Log License (All Rights Reserved with Research Exception).

The text, logs, and written transcripts on this Site are protected by copyright. You may not copy, reproduce, or redistribute the content in whole. Limited quotation for commentary, research, or journalism is permitted as described below.

  • Academic & Journalistic Use: We explicitly grant permission for researchers, journalists, and students to use data, excerpts, and quotes from the Site for studies, articles, and analysis.
  • Condition: You must credit Soul Phosphor Anomaly and link back to the source. You may not repost entire logs or mirror the Site.

1.2 Visual Arts License (All Rights Reserved).

The visual artwork, images, and graphics displayed on the Site are protected by copyright/intellectual property rights.

  • Protection: Regardless of the tools used to create them (including AI generation), these images are presented as part of the personal curation of the Site Owner.
  • Restrictions: You may not copy, reproduce, distribute, or create derivative works from the images without express written permission.

2. User Submissions & Community Guidelines

Preamble: No Confidentiality.

The Site is a public archive. By submitting content, you acknowledge that your submission will be publicly available and indexed. Do not submit sensitive, confidential, or private information.

If you submit content (logs, stories, comments, or data) to the Site (“Submissions”), the following terms apply:

2.1 License to Publish & Attribution Name.

You retain ownership of your Submissions. However, by submitting, you grant Soul Phosphor Anomaly a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to:

  • Display, reproduce, format, archive, and excerpt your Submission on the Site and associated promotional channels.
  • Analyze your Submission for internal research purposes (e.g., coding, aggregation, sentiment analysis). Clarification: This license does not grant the Site Owner permission to use your Submission to train third-party generative AI models.
  • Attribution Warning: The name you provide at submission will be the name used for attribution. We generally cannot change this later. Use a pseudonym if you desire privacy. If you choose a humorous or regrettable name, you accept that it will remain associated with your submission.

2.2 Warranties.

You represent and warrant that:

  • You own the Content or have the necessary rights and permissions to submit it.
  • Screenshots & Logs: If your Submission contains screenshots, logs, or quotes from third parties, you warrant that you have obtained explicit consent to publish them or that you have redacted all personally identifiable information (e.g., real names, physical addresses, phone numbers).
  • Your Submission does not violate the privacy, publicity, or intellectual property rights of any third party.

2.3 Prohibited Submission Content.

You agree not to submit content that includes:

  • Doxxing: Private personal information (addresses, phone numbers, employer details) of any individual.
  • Impersonation: Falsely representing yourself as another person or entity, or presenting fabricated evidence as fact.
  • Illegal Acts: Instructions for illegal activities, wrongdoing, malware, or phishing.
  • Hate Speech & Harassment: Targeted slurs, degradation, or content intended to incite violence or hatred.
  • Non-Consensual Content: Private conversations, logs, or images shared without the consent of all parties involved.
  • Minors: Any sexual content involving minors or content that exploits minors.
  • Infringing Material: Copyrighted material (books, articles, media) that you do not have the right to share.

2.4 Moderation & Editorial Discretion.

The Site’s Moderation Policy is incorporated into these Terms. Soul Phosphor Anomaly reserves the absolute right, but not the obligation, to:

  • Reject or Remove: We may refuse or remove any Submission at any time, for any reason, without notice. Submitting content does not guarantee publication.
  • Edit for Privacy: We may redact personal identifiers (e.g., changing a name to “[Redacted]”) or correct formatting/typos. We will not alter the fundamental meaning of your work.
  • Final Decision: All moderation decisions are final and not subject to appeal.

2.5 Data Retention & “No Archive” Promise.

The Site is not a permanent storage service. We do not guarantee that your Submissions will remain available.

  • Declined Content: Submissions declined by moderation are deleted from the public database. However, we may retain internal metadata (such as hash values or submission timestamps) solely for security and anti-abuse purposes.

2.6 Deletion Policy & Verification (Bucket 1: Author Requests).

To protect the integrity of the archive:

  • Deletion Keys: If the Site provides a “deletion key” or unique token at the time of submission, you must retain this key. It is the only accepted method for verifying ownership of an anonymous submission.
  • Responsibility: You are solely responsible for saving your Deletion Code. We cannot restore it.
  • No Key, No Deletion: If you lose your deletion key or cannot cryptographically prove you are the original author, we will not honor requests to remove or modify content.
  • Exceptions: This policy is subject to legal requirements and our discretion under Section 7.2 (Privacy & Safety Takedowns).
  • Third-Party Indexing: Deletion from the Site cannot remove copies indexed by search engines or archived by third parties.

2.7 Privacy by Design & Data Minimization.

The Site collects the minimum amount of data necessary to function.

  • No Accounts: We do not require accounts or collect email addresses.
  • One-Way Hashing: IP addresses associated with submissions are hashed using a one-way cryptographic function to detect abuse. We cannot reverse-engineer or decrypt these hashes to recover the original IP address.
  • Law Enforcement: We minimize data collection and generally cannot comply with requests for user data we do not retain. While third-party service providers (e.g., hosting, CDN) may temporarily retain connection logs, the Site Owner does not maintain a database of user identities or reversible IP logs.

3. Prohibited Uses (Access & Behavior)

3.1 Automated Access & AI Training.

  • Scraping: You agree not to use any robot, spider, scraper, or automated tool to access, copy, or monitor the Site.
  • Condition of Access: By accessing this Site, you agree not to use automated tools for data collection or to use Site content for AI training purposes. This prohibition is a condition of access.

3.2 Harassment & Malicious Use.

You agree not to use the Content to:

  • Harass, abuse, stalk, threaten, or defame any individual.
  • Post Content to third-party platforms (e.g., Reddit, X/Twitter) for the purpose of inciting ridicule, mockery, or “brigading.”

4. Disclaimers

4.1 AI Content Disclaimer.

This Site explores interactions with Artificial Intelligence. Content may contain hallucinations, factual errors, or unpredictable outputs. Do not rely on AI-generated content for medical, legal, financial, or professional advice.

4.2 Disclaimer of Warranties.

THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. SOUL PHOSPHOR ANOMALY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

5. Limitation of Liability

5.1 Cap on Damages.

To the maximum extent permitted by applicable law, in no event shall Soul Phosphor Anomaly be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

  • Monetary Cap: In no event shall Soul Phosphor Anomaly’s aggregate liability for all claims related to the Site exceed the amount you paid to access the Site (which is $0.00).

6. Indemnification

You agree to indemnify, defend, and hold harmless Soul Phosphor Anomaly from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your Submissions, your use of the Site, your violation of these Terms, or your violation of any rights of another party.

7. Takedown Requests

7.1 Copyright Complaints (Bucket 2: Legal Takedowns).

If you believe content on this Site infringes your copyright, you may request removal by sending a written notice that substantially includes the information required by 17 U.S.C. §512(c)(3) (DMCA).

  • Requirements: Your notice must include a physical or electronic signature, identification of the work and URL, contact info, and a statement under penalty of perjury that you are authorized to act on behalf of the owner.
  • Warning: Knowingly false notices may carry legal consequences. Incomplete notices may be ignored.

7.2 Privacy & Safety Takedowns (Bucket 3: Harm Prevention).

We may, at our sole discretion, remove or redact content that includes personal data, doxxing, or creates a credible risk of harm, even if the requester cannot provide a Deletion Key.
